Terms of Service

1. Acceptance of Terms

By accessing or using the wetracked.io software, the wetracked.io website or the wetracked.io app (“the Service”), you agree to be bound by these Terms and Conditions of Service (“Terms”). If you do not agree to any of these Terms, you are prohibited from using or accessing the Service. The materials contained in this website are protected by applicable copyright and trademark law.

2. Description of Service

wetracked.io provides a software platform that allows users to track their customers’ activity on their Shopify (and other) stores and feed this data directly into the respective Ad Platform’s pixel. The Service is provided on a subscription basis.

3. User Accounts

a. To access certain features of the Service, you must register for an account. You agree to provide accurate and complete information during the registration process.

b. You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities that occur under your account.

4. Subscription and Payment

b. Payment: Payment for the fixed subscription fee for your respective Subscription Plan is charged at the beginning of each billing period for all subscriptions initiated on or after April 13th, 2024. Payments for overcharges due to order usage above your chosen Subscription Plan is due at the end of the respective billing period and shall be charged together with the fixed subscription fee for the next billing period. (For subscriptions initiated before April 13th, 2024 payment is due at the end of each billing period.) Payments can be made through the payment methods provided. Subscription fees are non-refundable and subscribers specifically agree to be personally liable for charges agreed to under the chosen subscription plan. By clicking “Subscribe”, you acknowledge that you are authorizing wetracked.io to charge your default payment method today automatically and then every 30 days (recurring payment) unless you cancel. You may cancel anytime by going to the Billing page in accordance with our Cancellation policy in 4.e.

Please note that you remain subscribed and liable for the monthly subscription fee and relevant overcharges in respect to the Subscription Plan that you have chosen irrespective of, amongst others, the following:

    • whether your account is connected or not to any tracking sources, links, Shopify stores or funnels.
    • whether there is any order usage on your account or no usage.
    • whether the Shopify store links are active, inactive or archived.
    • whether you have paused your respective ads or ads campaigns.
    • whether your ad platform is active, paused, inactive or blocked.

    c. Changes to Fees: wetracked.io reserves the right to change subscription fees with notice. Continued use of the Service after fee changes indicates acceptance of the new fees.

    d. Trial Period: wetracked.io offers first time registered users a trial period of 14 days starting on the date of registration during which the user may test and experience the software.

    e. Cancellation: Subscribers may choose to cancel their subscription at any time by going to the Billing page. All subscriptions end at the end of the billing period during which a subscription is cancelled and the user agrees that they are liable for that full final billing period’s subscription payment inclusive of any overcharges for this last billing period.

    f. Debt collection: wetracked.io reserves the right to contract an independent third party debt collection agency to collect any uncollected amounts outstanding in relation to unpaid invoices. 

    g. Refunds: Please keep in mind that wetracked.io will issue a refund solely in the event of wetracked.io discontinuing its services to you without cause before the conclusion of the paid period, or if we are unable to deliver as committed. No other situations warrant a refund from wetracked.io and in no case will wetracked.io be obligated to issue any such refunds. 

    h. VAT Charges: wetracked.io charges VAT (value added tax) on top of our reflected pricing on the applicable territories and locations. It is the responsibility of the subscriber to enter their VAT Tax ID in the dedicated fields accurately to enable automatic VAT exemptions in qualifying scenarios. 

    5. Intellectual Property

    a. wetracked.io Ownership: The Service and its original content, features, and functionality are owned by wetracked.io and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

    b. User License: wetracked.io grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. This is the grant of a licence, not a transfer of title, and under this licence you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on wetracked.io’s website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server.

    6. User Conduct

    a. You agree not to use the Service for any unlawful purpose or in violation of these Terms.

    b. Prohibited Activities: Prohibited activities include but are not limited to, to modify or copy the materials; use the materials for any commercial purpose, or for any public display (commercial or non-commercial); attempt to decompile or reverse engineer any software contained on wetracked.io’s website; remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or “mirror” the materials on any other server. 

    c. The user licence shall automatically terminate if you violate any of these restrictions and may be terminated by wetracked.io at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.

    7. Privacy Policy

    Use of the Service is also governed by our Privacy Policy, available on our website.

    8. Disclaimer

    a. The materials on wetracked.io’s website are provided on an ‘as is’ basis. wetracked.io makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, wetracked.io does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

    b. Accuracy of materials: The materials appearing on wetracked.io’s website could include technical, typographical, or photographic errors. wetracked.io does not warrant that any of the materials on its website are accurate, complete or current. wetracked.io may make changes to the materials contained on its website at any time without notice. However, wetracked.io does not make any commitment to update the materials.

    c. Links: wetracked.io has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by wetracked.io of the site. Use of any such linked website is at the user’s own risk.

    9. Limitation of Liability

    In no event shall wetracked.io or its suppliers be liable for any damages (including, without limitation, indirect, incidental, special, consequential, or punitive damages, or any damages for loss of data or profit or revenue, or due to business interruption) arising out of the use or inability to use the materials on wetracked.io’s website, even if wetracked.io or a wetracked.io authorised representative has been notified orally or in writing of the possibility of such damage. 

    10. Termination

    wetracked.io reserves the right to terminate or suspend your account and access to the Service at its sole discretion, without prior notice.

    11. Governing Law

    These Terms are governed by and construed in accordance with the laws of the United States of America.

    12. Changes to Terms

    wetracked.io reserves the right to update or modify these Terms at any time. Updated Terms will be posted on the website with the effective date.
